This Data Processing Agreement is entered into between Yohoster, LLC and the Client. It applies to the processing of personal data by Yohoster while providing infrastructure management and engineering services.
1. Definitions
- Personal Data: Any information relating to an identified or identifiable natural person (specifically the shoppers and users of the Client website).
- Processing: Any operation performed on personal data, such as storage, optimization, or database migration.
2. Scope and Role
The Client is the owner of the data. Yohoster acts strictly as a service provider and technical processor. Yohoster will only process data to fulfill the engineering and maintenance tasks outlined in the Terms of Service.
3. Technical Integrity and Confidentiality
Yohoster agrees to:
- Ensure that all individuals authorized to process personal data have committed themselves to confidentiality.
- Implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption of onboarding credentials.
- Purge temporary administrative credentials once the specific engineering task or migration is complete.
4. Sub-Processors
The Client acknowledges that Yohoster uses established third party infrastructure partners (such as GoDaddy and ManageWP) to provide management services. Yohoster ensures that these partners maintain high security standards and are responsible for their own hardware level compliance.
5. Data Subject Rights
If the Client receives a request from a shopper to exercise their data rights (such as a request for deletion or access), Yohoster will provide reasonable technical assistance to help the Client fulfill these obligations within the WooCommerce environment.
6. Security Breach Notification
In the event of a technical security breach within the Yohoster management stack that affects Client data, Yohoster will notify the Client without undue delay and provide details of the remediation steps taken.
7. Termination and Deletion
Upon termination of the service agreement, Yohoster will cease all processing of Client data. Revoking the ManageWP connection key by the Client serves as an immediate termination of data access.
